There are a number of different statutes, depending on the state and city. The biggest problem is that it's usually a hit and run tactic. After throwing blood on someone they don't wait around to be arrested. If they are caught, and nobody was actually hurt, they're usually charged with misdemeanor assult, criminal mischief, vandalism, or whatever else the arresting officers decide to charge them with. Incarceration is very rare, unless the person has a long track record of doing this kind of stuff. If somebody IS hurt, however, then felony assult becomes a possible charge.
